What Is MiCA? A Guide for Crypto Businesses in Cyprus

The Markets in Crypto-Assets Regulation, known as MiCA, is the European Union’s harmonised framework for the issuance of crypto-assets and the provision of crypto-asset services. It came into full application across the EEA on 30 December 2024, replacing the patchwork of national crypto rules that previously applied in Cyprus and other Member States.

Why MiCA Matters for Cyprus-Based Firms

Before MiCA, crypto exchanges, wallet providers and token issuers operating from Cyprus were largely unregulated at EU level, relying on general AML registration with the Cyprus Securities and Exchange Commission (CySEC). MiCA changes this fundamentally: any firm providing crypto-asset services in the EU now generally needs to be authorised as a Crypto-Asset Service Provider (CASP), subject to prudential, organisational and conduct requirements comparable to those applied to investment firms.

What Falls Within Scope

MiCA covers a broad range of activities, including operating a trading platform for crypto-assets, exchanging crypto-assets for funds or other crypto-assets, custody and administration of crypto-assets on behalf of clients, placing of crypto-assets, and providing advice or portfolio management relating to crypto-assets. It also introduces separate regimes for issuers of asset-referenced tokens (ARTs) and e-money tokens (EMTs), commonly referred to as stablecoins.

The Cyprus Advantage

Cyprus has positioned itself as an attractive MiCA jurisdiction, building on its established reputation as an EU hub for investment firms and fintech companies. CySEC began accepting CASP applications for preliminary assessment ahead of the full MiCA application date, giving early movers a head start on the authorisation process.

Next Steps for Businesses

Firms already operating crypto services in Cyprus, and those considering entering the market, should assess whether their activities fall within MiCA’s scope, determine the appropriate licensing or notification route, and begin preparing the governance, capital and operational documentation the application will require.
