The Cyprus IP Box Regime: Achieving an Effective Tax Rate of Just 3% on IP Income

For technology companies, software developers and businesses that monetise intellectual property, the Cyprus IP Box regime remains one of the most competitive in Europe, and it emerged from the 2026 tax reform fully intact.

How the IP Box Works

The regime allows an 80% deemed deduction on qualifying profits derived from qualifying intangible assets. With the corporate income tax rate now at 15%, this produces an effective tax rate of approximately 3% on qualifying IP income, among the lowest available within the EU.

Qualifying Assets & Income

The Cyprus IP Box is fully aligned with the OECD’s “nexus approach” under BEPS Action 5. Qualifying assets include:

  • Patents and utility models;
  • Copyrighted software;
  • Other legally protected intangible assets that are novel and non-obvious, subject to conditions.

Qualifying income typically includes royalties, licence fees, and embedded IP income, as well as gains on the disposal of qualifying assets. Marketing-related intangibles such as trademarks do not qualify.

The Nexus Fraction

The benefit is linked to the level of research and development activity undertaken by the taxpayer. The greater the proportion of R&D expenditure incurred by the company itself (or outsourced to unrelated parties), the greater the portion of income that qualifies for the 80% deduction. Careful documentation of R&D spend is therefore essential.

Additional Incentives for Innovation

The IP Box can be combined with Cyprus’s enhanced R&D super deduction of 120% on qualifying research expenditure, which has been extended to 2030, as well as the Notional Interest Deduction on new equity. Together, these tools can reduce the effective tax burden of an innovation-driven business to low single digits, entirely within EU and OECD rules.
